The bottom floor (and on top of the roof) is fair game no matter who owns the depot.  It's the middle two floors where firing is disabled depending on who owns the cp.

Smoothie is correct.. ground level of the depot is ok to battle in.. inside the second and third floor are no fire zones for enemy troops..
